摘要 TheForeignInvestmentRiskReviewAct,orFIRRMA,signedbyPresidentTrumponAugust13,2018,significantlyexpandedthescopeoftransactionsinvolvingforeigninvestmentinU.S.companiesthatarecoveredbythenationalsecuritylawsoftheU.S.,commonlyknownastheCFIUSregime.Certainminorityinvestmentsandcertaintechnology-relatedinvestmentsmaynowneedtobesubmittedtotheCommitteeonForeignInvestmentintheU.S.(CFIUS)forclearance.FIRRMAalsoimplementsanexpeditedfilingprocess,whichinsomecasesismandatory,andexpandstheauthorityandenforcementtoolsofCFIUS.ThisnewlawinparttargetsChina’sinvestmentsintheU.S.anditsattemptstoprocureU.S.-basedtechnology.ThisarticlediscussesthenewlawandanalyzestheimplicationsofthelawonChineseinvestmentintheU.S.
